Local Business, Trading and Taxation
To assist our clients in their local business operations we
provide advice covering all aspects of doing business in Saudi Arabia,
including local trading activities and tax matters.
In addition to the registration of a business upon its
formation, there is complex set of rules, regulations and customary "practice"
controlling and affecting commercial operations and trading in the Kingdom. We
provide legal services to meet the practical requirements of businessmen
operating in this environment, including advice and assistance in connection
with the following matters:
- Consumer Goods Purchase Agreements
- Commercial Lease Negotiations
- Compliance with Saudi Arabian Standards and
Specification
- Application of the "30% Rule"
- Authentication of Documents
- Equipment Leasing & Sale
- Import Requirements & Procedures
- Sponsorship of foreign personnel
- Employment Contracts, Drafting &
Application
- Labor matters
Commercial agencies are used quite frequently in the Kingdom
and we have assisted many clients in establishing agency and/or distributorship
relationships with foreign partners. In connection with such activities we
undertake the negotiation of significant contractual terms such as agency fee
arrangements, commission sales, contract term, exclusivity of rights, scope of
territory and termination rights, and take responsibility for drafting and
registering such agreements with the Ministry of Commerce.
Trading activities, as distinguished from other commercial
businesses, are reserved exclusively for wholly Saudi owned entities in the
Kingdom and are subject to their own specific regulations and restrictions. We
offer counsel to our Saudi clients in respect of such activities and ensure
their full compliance with the relevant local authorities.
The tax regulations applied in the Kingdom are also complex and
call for specialized expertise to fully understand their application. Working
with internationally recognized accounting firms having local offices we assist
our clients in optimizing their tax situations and in obtaining clearance
certificates from the taxation and zakat authorities. |
